A Report on yesterday's Dharna @EPFO Ranchi:


BSREA, Bokaro; SAIL Ex-Employees Associan, Ranchi & SRU, Ramgarh and Bokaro conducted a joint Dharna and Demonstration in front of EPFO Ranchi.  A delegation led by Dr.V.N.Sharma consisting of Sri Ram Agar Singh, Sri SNP Gupta, Sri Emmanuel Kuzur, Sri A.N Sahay and Sri J. Bose met Dr. V.P. Singh, Addl CPFC & Ms S.K.Sangma, RPFC , Ranchi and presented a Memo and discussed the issue of urgent decision on payment of full pension to Retirees of SAIL and others belonging to Exempted Establishment. Both the EPFO Officers assured that they will forward our Memo with favourable comment. However, the decision will be taken by CBT and higher level.  The Meeting and Dharna , Demonstration ended after a vote of thanks proposed by FORSE Chairman.

A Report on yesterday's Dharna in EPFO, Delhi, Kolkata & Shimoga (Karnataka) Office

Dear friends,

As announced earlier large number of SAIL Retirees, alongwith EPS-95 Pensioners from other PSUs, collected at EPFO H O Delhi yesterday and conducted Dharna/ Demonstration to demand Implementation of Supreme Court Order for Payment of Full Pension under EPS 95, when CBT Meeting was going on inside the EPFO. You can see the SAIL Retirees led by S/Sri OP Wadhwa, KL Sharma and others in the Video in the following link.  


The progamme was carried out by SAIL Retirees in Kolkata also which was led by Sri SK Ghosh and others and who presented a Memo to the EPFO Kolkata. Similar and massive demonstration was held at Shimoga by our VISP Retirees led by Sri Nagabhushan. These can be see in the attached Photographs.

I am very thankful to my entire SAIL EPS’95 pensioners’ fraternity located in Delhi, NCR, UP, HP, Haryana and Panjab and also those in Kolkata and Karnataka State for leaving no stone unturned in ensuring the event a great success in their respective locations.

As per my information (subject to confirmation), there was very heated discussions on our issue within the CBT Meeting that lasted for about half the duration of meeting and finally, it was decided that a meeting will now be held by the MOL&E with Secretary Labour, Jt. Sec Labour, CPFC and all CBT members representing Employees to further discuss on the issue in which one or two representatives of EPS’95 pensioners may also be invited.

Statement on Developmental and Regulatory Policies - October 4, 2017-
Banking Facility for Senior Citizens and Differently abled Persons
Please refer to Paragraph 8 of Statement on Developmental and Regulatory Policies, released by Reserve Bank of India on October 4, 2017 as part of Fourth Bi-monthly Monetary Policy Statement 2017-18, a copy of which is enclosed. It has been observed that there are occasions when banks discourage or turn away senior citizens and differently abled persons from availing banking facilities in branches. Notwithstanding the need to push digital transactions and use of ATMs, it is imperative to be sensitive to the requirements of senior citizens and differently abled persons.

2. In view of the above, banks are required to put in place appropriate mechanism with the following specific provisions for meeting the needs of such customers so that they are able to avail of the bank’s services without difficulty.

(a) Dedicated Counters/Preference to Senior Citizens, Differently abled persons
Banks are advised to provide a clearly identifiable dedicated counter or a counter which provides priority to senior citizens and people who are differently abled including visually impaired persons.

(b) Ease of submitting Life Certificate
As per extant guidelines issued by Department of Government and Bank Accounts, in addition to the facility of Digital Life Certificate under “Jeevan Praman” Scheme (refer circular DGBA.GAD.H-2529/45.01.001/2014-15 dated December 9, 2014), pensioners can submit physical Life Certificate form at any branch of the pension paying bank. However, it is observed that often the same is not updated promptly by the receiving branch in the Core Banking Solution (CBS) system of the bank, resulting in avoidable hardship to the pensioners. It is, therefore, advised that banks shall ensure that when a Life Certificate is submitted in any branch, including a non-home branch, of the pension paying bank, the same is updated/ uploaded promptly in CBS by the receiving branch itself, to avoid any delay in credit of pension.

(c) Cheque Book Facility
(i) Banks shall issue cheque books to customers, whenever a request is received, through a requisition slip which is part of the cheque book issued earlier.
(ii) Banks are advised to provide minimum 25 cheque leaves every year, if requested, in savings bank account, free of charge.
(iii) Banks shall not insist on physical presence of any customer including senior citizens and differently abled persons for getting cheque books.
(iv) Banks may also issue cheque books, on requisition, by any other mode as per bank’s laid down policy.
It is further clarified that providing such facility in BSBDA will not render the account to be classified as non-BSBDA (c.f. Bank’s response to query number 14 and 24 of our circular “DBOD.No. Leg. BC.52/09.07.005/2013-14 dated September 11, 2013 on Financial Inclusion – Access to Banking Services - BSBDA – FAQs”).

(d) Automatic conversion of status of accounts
Presently, in some banks, even fully KYC - compliant accounts are not automatically converted into ‘Senior Citizen Accounts’ on the basis of date of birth maintained in the bank’s records. Banks are advised that a fully KYC compliant account should automatically be converted into a ‘Senior Citizen Account’ based on the date of birth available in bank’s records.

(e) Additional Facilities to visually impaired customers
Banks are advised that the facilities provided to sick/old/incapacitated persons vide Paragraph 9 of our Master Circular DBR.No.Leg.BC.21/09.07.006/2015-16 dated July 1, 2015 on Customer Service in Banks (regarding operations of accounts through identification of thumb/toe impression/mark by two independent witnesses and authorising a person who would withdraw the amount on behalf of such customers) shall also be extended to the visually impaired customers.

(f) Ease of filing Form 15G/H
Banks are advised to provide senior citizens and differently abled persons Form 15G/H once in a year (preferably in April) to enable them to submit the same, where applicable, within the stipulated time.

(g) Door Step Banking
We have issued instructions on Doorstep Banking vide circular DBOD.No.BL.BC.59/22.01.010/2006-2007 dated February 21, 2007 under Section 23 of Banking Regulation Act, 1949. However, in view of the difficulties faced by senior citizens of more than 70 years of age and differently abled or infirm persons (having medically certified chronic illness or disability) including those who are visually impaired, banks are advised to make concerted effort to provide basic banking facilities, such as pick up of cash and instruments against receipt, delivery of cash against withdrawal from account, delivery of demand drafts, submission of Know Your Customer (KYC) documents and Life certificate at the premises/ residence of such customers.

3. Banks are advised to implement these instructions by December 31, 2017 in letter and spirit and give due publicity in their bank branches and website.

8. Banking Facility for Senior Citizens and Differently abled Persons
It has been reported that banks are discouraging or turning away senior citizens and differently abled persons from availing banking facilities in branches. Notwithstanding the need to push digital transactions and use of ATMs, it is imperative to be sensitive to the requirements of senior citizens and differently abled persons. It has been decided to instruct banks to put in place explicit mechanisms for meeting the needs of such persons so that they do not feel marginalised. Ombudsmen will also be advised to pay heed to complaints in this context. Necessary instructions in this regard will be issued by end-October 2017.

Request to depute Sri SPS Jaggi, EDP, SAIL to discuss SAIL Mediclaim Scheme

Dear Sir,

Out of the many issues like SAIL Pension Scheme, Financial assistance to Pre-2007 Retirees and SAIL Mediclaim Scheme and the Govt attitude towards PSU Retirees on Interest Rates on FDs esp for Sr. Citizens and EPS 95 that were discussed and decided in our 7th Apex Council Meeting at Salem on Sept 12-13, 2017 a special mention is required to be made on the issue of inefficient functioning of SAIL Mediclaim Scheme. Starting from listing of Hospitals, cappings and use of words in the Guidebook to day to day functioning like asking for cancelled cheque every time, delay in payment/ settlement of Bills etc and almost no response from SAIL, UIIC and MDIndia to the problems faced by the Retirees nothing works to the satisfaction of the Retirees. In view of this the members took a Resolution which is as follows:

It is resolved to request SAIL Chairman to depute Sri S.P.S Jaggi, EDP, SAIL to have a two day exclusive discussion on the functioning of SAIL Mediclaim Scheme, with Principal Office Bearers of FORSE preferably at MTI Ranchi (or Bokaro, Kolkata or Delhi) at an early date with about seven days advance notice (to make travel arrangement). 

In view of this I request you, Sir, to kindly depute Sri Jaggi to discuss the issues of SAIL Mediclaim Scheme with FORSE representatives at a place of his choice.

RESOLUTION
Against privatisation/ sale of SAIL plants
This issue was deliberated as agenda item in 7th Apex Council meeting at Salem on 12th Sept 2017 attended by representatives of all affiliated units/ associated organisations from Bokaro, Bhilai, Rourkela, Salem, VISL, Ranchi, Kolkata, SRU, Hyderabad, Chennai, Bengaluru and Mumbai at length and took note of the seriousness of the issue emanating out of recommendations of NITI AYOG to the Government of India and possible move of Government in this direction. The Apex Council members felt very much indignant over this dangerous move. The members recalled the basic reason of formation of these units and operation of these units under SAIL. Apart from fulfilling the avowed social objectives, these units have been hitherto catering to the needs of priority/ critical sectors in the country and a holistic view was taken in respect of profitability of the company as a whole so far instead of having singular approach as SAIL is contributing large sum every year to national exchequer.
It is, therefore, imperative that instead of hiving off these units, modernization and upgradation plans should be chalked out with infusion of fresh capital with financial support from Central Government. It will make them commercially viable also by identifying certain government sectors who meet their requirements from these units only.
The members also strongly felt that when Government is giving tacit support to some large defaulting organization with very high NPA by providing financial concessions through PSU Banks, the same consideration ought to be made to rehabilitate these units to make them operationally and commercially viable. It is also intriguing to perceive the intention and plans of intending purchasers ultimately and how and in what form these units will be shaped up
Taking an overall view in above panorama the Apex Council feels constrained to take unanimous resolution in this meeting today reading as under and desires this to be sent to Hon’ble Prime Minister, Union Minister of Steel, Chief Ministers of the concerned States and concerned MPs, Secretary Steel, Chairman SAIL and members of SAIL BOD.
"It is hereby resolved that the move, if any, with regard to Sale/ Privatisation of three units - ASP Durgapur, SSP at Salem and VISL at Bhadravati - be stopped forthwith with fresh consideration of making these units operationally and commercially viable as this purported draconian step is construed as anti-national and contrary to avowed objectives of creation of such units under public sector.
It is thought that this move will have wide scale repercussions with already growing resentment everywhere"
We, the undersigned, appeal all concerned with a hope that the Government will give due consideration to all these factors and desist from going ahead from such move, as privatisation/ sale of SAIL plants, if any.

Options for EPS 95 Pension

Dear Apex Council Members,

The following WhatsApp message from Sri Gurumukh Singh, which was circulated to Sr. Members of the Core Group, is reproduced below for your kind perusal.

"I along with 10  representatives of various exempted Central PSUs (NTPC, IPC, BPCL ONGC, PFC) met Advocate S/Shri Anip Sachthey and  Aditya Dhawan on 25.08.2017 in Delhi and deliberated the case vis-a-vis SC Judgment with the advocates. We also discussed on the circulars issued by  CPFO dated 23.03.2017 and 31.05.2017 and its merit.

You are aware,  Shri Anip Sachthey & Shri Aditya Dhawan are Supreme Court lawyer and are famous for the case of RC Gupta Vs EPFO fight where SC has given the landmark judgment against CPFO and EPFO.

The advocates has agreed to take up the case and wants to fight the same in Supreme Court on our behalf mainly with the contention of scrapping arbitrary advisory dated 31.5.17 which has no legal locus-standi nor any reference in any of the judgment. The advocate requested the delegation to submit a write up on EPS 95 issue along with all the relevant documents in seritum available with every individual Association.

The advocate has asked an initial fee of Rs 2.5 lac per Association to fight the case.

Observations and suggestions from Dr.V.N.Sharma: Based on WhatsApp interaction with other PSUs and their Fed/ Assn I have the following to say:
  1. Hoping that CBT might decide the issue in our favour, of rejecting the 31st May 2017 EPFO Circular against Exempted Establishments, most of the PSU Retirees Associations/ Federations are keeping the Court route on hold for the outcome of CBT meeting (which is not scheduled yet.)
  2. Since CBT route will get each one of us an opportunity to go ahead with the Pension process it is preferred whereas Court route will require each and every interested member to sign Petition/ Vakalatnama because only Petitioners will get the advantage of the favourable Court Order. 
  3. FORSE (Dr.VNSharma on our behalf) has served a Legal Notice to EPFO, New Delhi. Even if it is replied it may not be very helpful.
  4. Preliminary legal advice recd through informal channels are 
  • that since we do not have direct membership of FORSE it will not be helping members as each interested member will have to sign the Petition/ 'Vakalatnama'.
  • that in case FORSE is expected to go to Court it will be Bhubaneshwar High Court only as its Jurisdiction is limited to Dist of Sundargarh.(It does not have All India operational jurisdiction). - Sri Abhay Das to check it please.
  • All Regd Associations only can go to High Court with signature of each interested members on the Petition/ Vakalatnama.  
  • An estimate of expenses can be had from the above highlighted 'an initial fee of Rs 2.5 lac per Association to fight the case. Final amount can be anybody's guess.
  • Individual Unit Associations of FORSE may please consider the financial engagement & involvement before taking a decision on the issue. 
  • Since Regd. Unit Associations will have to take the legal route the decision of the Unit Associations, in my opinion, will have to be independent of FORSE or sister Unit Associations.
I request you all to kindly (i) discuss the EPS 95 issues seriously with formal legal advice from a competent lawyer (No hearsay please), (ii) check the above facts with the lawyer and (iii) take appropriate decisions with an estimated number of Petitioners from your Unit and financial commitment of the members. 

I assure you of updating you all as and when it is needed so that Units take appropriate decision before coming to Salem.

Dear Sir,
This is to draw your kind attention to the seriousness of the issues of the Retirees being ignored by SAIL for years. A correspondence held in January this year esp between SAIL and FORSE, almost on the eve of our 3-day Agitational Action wef Feb 07, 2017 in front of SAIL Corporate Office, Lodi Road, New Delhi, is attached herewith for your kind perusal. the enthusiasm was short lived as SAIL forgot all about it the moment participants of Delhi Agitation & demonstration too their return journey. 

As we have intimated, creation of the post of Nodal Officers in SAIL Units has yet to be operationalised at the Unit level even after 7 months of announcement by SAIL and creation of a Apex level Nodal Officer at SAIL CO, New Delhi is also not in air till this day. It is clear beyond any doubt that even this tiny step was only a half- hearted approach. SAIL Pension Scheme is yet out of bounds for the post - 2006 Retirees, no move to provide financial assistance to pre-2007 retirees, finalisation and implementation of SAIL Mediclaim Scheme is also not much to be happy about. A dozen request from us failed to generate a sense to recognise FORSE and invite its representatives for a direct dialogue to understand and find solution to the Retirees' issues. 

Sir, if you don't mind I would like to compare your officers handling Retirees issues including Healthcare issues with the French Admirals, of the famous Historical French Revolution period, who had not seen sea. If it is just extended with experience they don't appear to be worthy of higher responsibility which they are bestowed upon by virtue of their position in SAIL.

In view of the above I request you to kindly grant recognition to FORSE and invite us for at least a two day meeting as per your convenience. 
A line of acknowledgement with an invitation for a SAIL-FORSE meeting will gladden our heart esp if this reaches us before our Apex Council Meeting at Salem on Sept 12-13, 2017

It has two sides of the same coin which is affecting SAIL’s performance. (i) Govt threatening SAIL top brass and (ii) Govt policies of controlling the Steel behemoth (a) through appointment of useless, unworthy independent Directors, ignoring the professional stake holders like MDs of ISPs and Sr Executives, to provide some respectable berth to their party men is not for making profits for SAIL. (b) Govt giving threats for privatising SAIL Plants is anpther ploy to demoralise the professionals working on the ground, make it a losing concern and then hand it over to some private enterpreneurs for some give and take. 

What SAIL top brass should have done is to ‘Leave their egos here’ recall Retired personnel of high calibre, entrust them with some responsibility and use their long & short term advice. No doubt SAIL has become a self-centered egoistic behemoth, with extremely bad communication system like No response for years. And it is uniformly being done throughout SAIL incl all its Units. In any case SAIL should gird up their loins and take the challenge with Retirees with them shoulder to shoulder. With best wishes.

We all know that how long the Govt took to allot Rowghat mines to SAIL which was pending with the Govt agencies for more than 20 years by which time the place and surrounding places have become naxalite infected in Chattisgarh and is becoming a herculean task to get the infrastructure in position.You can imagine SAILs position if the mine would have been in full swing by now.We all know about the lip service by all Govt machinery and the high level of commitment by SAIL executives in general.This is the same very SAIL which was turned around by visionary Shri.V.Krishnamoorthy who was hand picked by Shri.Rajeev Gandhi.

I fully endorse the views expressed by Chairman , FORSE.
The Promotion to ED in different categories goes for TENDER. Highest bidder gets it whether  he delivers the result or not.
SAIL call the retired personnel who have been dedicated to the organisation. . SAIL can be revived again.

Lok Sabha EPS 95 Debate links

Sri N.K. Premchandran, a Kerala MP raised today the issue of Pensions under different Schemes with some emphasis on Payment of enhanced Pension to Pensioners belonging to Exempted Establishments under EPS 95 as per SC decision in Lok Sabha quite aggressively. In fact he also threatened that he may have to approach SC if it is not resolved.
