JOF for EPS 95

1.      EPFO has returned the hard copies of Joint Option Form (JOF) submitted by eligible pensioners to SAIL and asked pensioners to submit JOF afresh in the link https://unifiedportal-mem.epfindia.gov.in/memberInterfacePohw/  The last date for submission has been extended to 3rd May 2023.

2.      After giving detailed consideration to all aspects of the recent SC judgement, our suggestion is that all eligible Pensioners or spouses must submit the Joint Option Form (JOF) without fail. We also suggest members not to make mistakes while filling up the JOF and make sure to provide correct information only in the JOF.

3.      The pre-01/09/2014 ineligible pensioners may please note that a few Review Petitions and Miscellaneous Applications have already been filed in SC. Our case is.

Let us wait for the verdict by SC.

Digital submission of Joint Option Form (JOF)

Sub: Digital submission of Joint Option Form (JOF) for Higher Pension.

Madam,

This is to bring to your kind information that as per the latest Circular of EPFO No. Pension /2022/56259/6541 dated 20.02.2023 only digitally submitted copies of JOF by eligible pensioners will be accepted by EPFO offices for Higher Pension. At the sametime, the running banner/message at the EPFO Website link https://www.epfindia.gov.in/site_en/index.php reads as

“Supreme Court Judgement dated 04.11.2022 in the matter Special Leave Petition (c) Nos. 8658-8659 of 2019 "In compliance of the direction contained in the para 44 (iii) & (iv) read with Para 44(v) of the judgement (for employees who were in service prior to 01.09.2014 and continued to be in service on or after 01.09.2014 but could not exercise joint option under erstwhile proviso to para 11(3) of EPS-1995), online facility for filing joint option is coming soon"  

This clearly means that online facility is yet to be provided by EPFO. We are afraid that as a result this delay may, in turn, lead to further delay in meeting the last date for submission of JOF causing disqualification of the eligible pensioners by EPFO.

In view of the above, we request you to kindly (i) take up the issue of with EPFO for extending the date for JOF submission and (ii) set up a help desk in each SAIL plant/ unit for providing assistance to eligible SAIL pensioners in online submission of Joint Option Form as and when EPFO provides the link.

Request to allow pre-01/09/2014 pensioners to submit the Joint Option forms

Sub: Request to allow all EPS 95 SAIL pre-01/09/2014 EPS 95 Pensioners to submit Joint option for Higher Pension.

Ref:  Our letter Nos. FORSE/SAIL-C/0223 dated 01/02/2023 & FORSE/SAIL- C/0323 dated 03/02/2023

Madam,

In continuation of our above referred letters this is to bring to your kind information that SAIL website for EPS 95 defines Eligibility for submission for JOINT OPTION FORM as follows:

1.    Employees who are on the rolls of the Company

2.    Ex-employees who have attained the age of 58 years on or after 01-Sep-2014

Thus, ignoring our serious and sincere request to you, SAIL has permitted only the post-31/08/2014 pensioners to fill up the Joint option form and, by this action, SAIL has debarred the pre-01/09/2014 pensioners from getting Higher Pension forever.

As we wrote in our previous letters “When Govt/ EPFO provided opportunity to employees to submit joint option for full pension, SAIL/ SAIL Unit PF Trusts failed to inform and guide the employees and the pensioners to take the benefit of the amended scheme. This resulted in long time loss of full/ higher pension under EPS 95 to serving and retired employees of SAIL.”

Further to rectify the situation and getting justice to the SAIL pensioners we requested you “to kindly take this up with EPFO and, if need be, for a legal recourse in the Supreme Court to get the Supreme Court order dated 04th Nov 2022 amended to remove cutoff date and permit all desirous pensioners to submit joint option. SAIL may formally/ informally take lead in this matter and take other CPSE Exempted Establishments along for success of this joint move.”

Considering the above facts, we urge you to be kindly sympathetic and reasonable to the cause of pre-01/09/2014 pensioners pathetic financial condition, without an assured back up, and allow them to submit the Joint Option forms and parallelly initiate necessary long-term action in this matter, if need be, in association with other CPSE Exempted Establishments.

Madam,

This is to bring to your kind information that in spite of our various communications, as given in the above references, on the subject issue, SAIL appears to be going slow in providing link with uploaded data for submission of joint option by all the SAIL EPS 95 Pensioners.

A good number of Exempted Establishment employers esp. the PSUs have circulated instructions alongwith appropriate Joint option Forms. Attached herewith in email page are the three circulars - from HMT, BHEL & LIC - for Joint option declaration by their respective EPS 95 pensioners. HMT & BHEL have fixed 10th Feb 2023 for submission of declaration to their respective HR departments which will forward the same after scrutiny etc to EPFO by 20th Feb 2023. LIC has fixed 15th Feb 2023.

Silence of SAIL, on this score, is deafening to the old-aged pensioners as it is not clear when they will be allowed to submit options and when it will be scrutinized / verified by SAIL units. No doubt that this may cause further delay in their landing in EPFO offices in the last minute, causing tension to SAIL Pensioners.

In view of the time constraint, I request you to kindly advise the concerned SAIL personnel/ Nodal Officers to do the needful to expedite the submission of Joint option by all SAIL EPS 95 pensioners for Higher Pension.

Madam,

This is to bring to your kind notice that when Govt/ EPFO provided opportunity to employees to submit joint option for full pension, SAIL/ SAIL Unit PF Trusts failed to inform and guide the employees and the pensioners to take the benefit of the amended scheme. This resulted in long time loss of full/ higher pension under EPS 95 to serving and retired employees of SAIL. It will also be interesting to note that our sister company RINL did a good publicity on this count, got the joint option submitted by large number of the Employees/ Pensioners which got ultimately rejected by EPFO Visakhapatnam. But today they are in a position to reap the benefits of the Supreme Court Order dated 04th Nov 2022.

As a follow up of the above, we request you to kindly take this up with EPFO and, if need be, for a legal recourse in the Supreme Court to get the Supreme Court order dated 04th Nov 2022 amended to remove cutoff date and permit all desirous pensioners to submit joint option. SAIL may formally/ informally take lead in this matter and take other CPSE Exempted Establishments along for success of this joint move.

We would also like to inform that a good number of CPSE Exempted Establishments viz. HPCL, KUDRAMUKH (KIOCL), STC, etc have allowed their post- 31/08/2014 EPS 95 pensioners to submit joint option. Madras High Court in its order dated 25/01/2023 (Copy of MHC order attached) has also ordered accordingly.

In view of the above we request you to kindly issue circular to all retirees covered under EPF Pension Scheme to exercise joint option prior to 03.03.2023 without waiting for EPFO in order to avoid any eleventh-hour rush and tension to senior citizens.
