Letter to SAIL re Issue of RPFCs rejecting PoHW Applications

An update from Sri TK Dutta General Secretary of Durgapur Unit of FORSE: The Writ Petitions of Retirees of CMO, DSP, ISP, IRCON and BPCL are coming up for Hearing on 09.09.2025 before the Hon'ble High Court of Kolkata. EPFO submitted its Replies and the Petitioners have also submitted Rejoinders. It is expected to be a meaningful Hearing particularly in the light of Judgement of Madurai Bench of Madras High Court dated 02.09.2025.

Dear Sir,

Further to our above referred letter on the subject issue we would like to bring to your kind information that there appears to be no change in the position of Regional EPFOs wrt the amendment in the SAIL Units PF Trust Rules. As a result, the rejected applications for Higher Pension of large number of SAIL Retirees from ASP, BSP, CO, CMO, ISP, SSP, VISP, eligible for Higher Pension as per Supreme Court order dt 04/11/2022 stands still as rejected. We are not aware if SAIL has issued advisories to its Unit PF Trusts to go to the courts of law for its resolution. But to the best of my knowledge only DSP management has gone for litigation and so have done a few retirees’ groups of Salem, Bhadrawati and Bhilai Steel Plants.

In the meantime, in a similar matter as ours, Madurai Bench of Madras High Court has issued an Order on 02/09/2025 against the order of EPFO dated 06.02.2025 wherein the joint option request submitted by the employees to avail the benefits of higher pension have been rejected primarily relying upon the Trust Rules applicable to the exempted organisation namely BHEL,Trichy (copy attached).

We request you to kindly act fast and do the needful even if it requires going centrally or unit-wise for litigation to resolve the issue so that SAIL eligible Pensioners do not suffer.

Sub: Our Appeal to extend the last date of renewal/ enrollment for SAIL Mediclaim Scheme 25-26 to 31st Aug 2025 for all categories of Retirees like Gap cases, Topup etc.

Sir, 

This is to bring to your kind notice that as per the message received by us an appreciable number of Ex-Employees could not complete their renewal/ enrollment for SAIL Mediclaim Scheme 25-26. Though the system was far better than what it was in previous years yet it was found blocked at times which led to members failing to complete the process of renewal/ enrollment. Add to that the uncertainty of network operation of the members.

Sir, in view of the above, we appeal to you to kindly extend the date of renewal to 31st Aug 2024. A good gesture from your end on an auspicious day like Rakshabandhan will be appreciated by us all.
